n 2005, the front page of Melbourne’s main metropolitan broadsheet newspaper carried an article defending the use of torture.1 It was not the first such article to appear in the mainstream media of the world, but it was the first such article in Australia. Mirko Bagaric and Julie Clarke’s argument was ludicrous, but suddenly the concept of “justifiable” torture was appearing everywhere. At the heart of their article was a (now well-known) example, that of the “ticking bomb”. The same example has been used as the basis of Hollywood movies and innumerable defences of torture.
